The case has been filed against Jyoti Prakash Pandey, CEO of Nepal Investment Mega Bank, on the charge of cheating, organized crime and banking fraud. The case was filed against him at the Kathmandu District Court on Wednesday after a long investigation by the CIB.

The case has also been filed against CEO Pandey, Chairman Prithvi Bahadur Pandey, directors Prajanya Raj Bhandari, poet Kumar Tibrewala, Diwakar Shakya Udai, Shalikram Belbase and Shova Shrestha.TAG_OPEN_div_22 The police have said that the directors of the bank are absconding.

The case has been filed against them in the case of auctioning the property of Smart Cell, which has already reached the ownership of the government. Ncell had accepted the auction of the property already owned by the government. A case has also been filed against the CEO of the bank in this case. He was arrested by the police during the investigation of the case and later the Supreme Court ordered him to sit outside and conduct the investigation.

Now TAG_OPEN_strong_12 the question arises: Can a person accused of fraud, organized crime, and banking fraud continue to be the CEO of the bank?

According to the Bank’s Employee Bylaws, he will automatically be suspended as CEO.TAG_OPEN_div_17 As per the Nepal Investment Mega Bank’s Employee Bye-laws, the employees of the bank will be automatically suspended from the time the case is filed against them until they are cleared. Earlier, the employees of the same bank who were involved in banking fraud were suspended from the date of the case.

However, the Bank and Financial Institutions Act provides for the removal of the post only if the person is found guilty. If a person is convicted of a crime and does not pay his sentence or if he is convicted, he will not be a CEO for 5 years.

However, this is also a moral question. The question of how a person can become the executive head of a bank after being prosecuted for fraud, organized crime and banking fraud is a complex question in itself. It remains to be seen whether CEO Pandey will resign or what will happen after understanding this complexity. Since all the directors of the bank are absconding, there is no possibility of going to the board of directors immediately. Now the action of the Rastra Bank is going to be decisive in this.

Kathmandu.
